Captain Smart must be told the hard truth in the face that resignation from employment cannot just be delivered on social media.
There are laws in Ghana regarding labor and that must be applied. News is viral in Ghana’s media space that Captain Smart has announced his decision to resign from the Angel Broadcasting Network (ABN).
In his own words, Dr. Kwaku Oteng who is the Chief Executive Officer of the Angel Broadcasting Network cannot contain his rants if he should return and that has informed his resignation.
“I can never shut up so maybe if I come back your work will collapse so in short, I will not return again. Yesterday I met your lawyer, he came here. I respect you a lot but for your Job to be guaranteed, please it cannot be because of me that you will be paying a lot of taxes so I have stepped aside. But I will never go hungry”. These were the words of Captain Smart.
However, he was unable to tell his audience if he has communicated his decision to Dr. Kwaku Oteng or not.
Captain Smart must be aware that his suspension was communicated through a written statement and has to return the same gesture if he is resigning.
The labor laws of the country state that before employment can be terminated by either party, notices must be provided.
If Captain Smart was employed on a contract of less than three years, a two-week written notice must be given.
If Captain Smart was on contract for more than three years, then he has to provide one month's notice to Dr. Kwaku Oteng before leaving the company.
It is unknown if Captain Smart has already fulfilled the above obligations but with these laws in mind, he cannot resign by just a verbal statement on his Facebook page.
He needs to officially write to Dr. Kwaku Oteng and present an official resignation letter. He also has to provide a grace period to enable Dr. Kwaku Oteng to find a replacement before he can leave the company.
We must not forget that Captain Smart was only suspended and has not been sacked from the company.
