Ejisu SHS Assistant Headmaster In Police Custody For Unlawful Incarceration Of Students

The Ghana Police service in Ashanti Region are very angry when two suspected students stole an electric stabiliser worth of GH¢4OOO.

The Public Relations Officer at Ashanti Region command tells Joynews that a student who is a suspect is aiding them in their investigations.

The Public Relation Officer said the assistant headmaster is invited as well to assist them in their investigations.

Kofi Appiah who forced the students to go half-naked and held them overnight under his own custody for stealing the school's electric stabiliser worth of GH¢4OOO.

According to information gathered these two students were caught and handed over to authorities by a taxi driver when the students made an attempt to jump a fence wall.

Due to that incident of locking these two students for stealing the schools stabiliser,one of the students is said to have drank liquid soap he picked from the custody room in other to commit suicide.

The police condemns the action taken by the Assistant Headmaster as illegal and condemnable.

ASP Godwin Ahianyo who is Public Relations Officer said the Assistant Headmaster don't have any right to do what he did.

ASP Godwin Ahianyo said exactly this "You can lock someone in a room overnight per the laws in the country. It can only be done by police officer or a security officer".

For further clarification and understanding ASP said quoted some aspects of the constitution that speaks against this act.

Section 12(c) of the criminal and other offenses Act 196O,Act 3O says a private person who in his presence commits any offence in the nature of stealing or fraud.

The Criminal and other offences Act,196O (Act 3O) provides per Section 12(titled arrest by private persons without warrant) that:

1. A private person may arrest without warrant any person who in his presence commits;

a. any offence involving the use of force or violence.

b. any offence in the nature of stealing or fraud.

c. any offence involving injury to public property.

d. any offence whereby bodily harm is caused to any person.

ASP Godwin says the Assistant Headmaster abused the law.

To end his talk,he said when someone is caught in a bad act you can hurt him or her by putting the law into your own hands.
