Ghanaian Judges Should Stop Misinterpreting And Misapplying Article 94(2) - Kwaku Azar

Lawyer and KPMG Professor in Accounting at the Fisher School of Accounting, University of Florida Stephen Kwaku Asare widely known as Kwaku Azar has asked Ghanaian Judges to stop misinterpreting and misapplying of article 94(2).

In a post shared on his official Facebook page on Wednesday, 29th June 2022, he wrote that Article 94(2) disqualifies persons from being an MP on moral grounds and incompatible occupations. Allegiance as used in that article, for the 1,000th time has nothing to do with citizenship.

"Ghanafuo judges should stop misinterpreting and misapplying article 94(2)(a). Allegiance to a country other Ghana is clearly explained by the memorandum to the 1968 constituent assembly paragraphs (416-417)." He wrote

Kwaku Azar further added that even without the benefit of the memorandum, the mere fact that article 94(2)(a) was in the Constitution even when dual citizenship was outlawed should have been conclusive that it had nothing to do with citizenship.

"But this is Ghana!There is too much misinterpretation of very simple laws." He lamented.
