The National Communications Officer of the National Democratic Congress, Lawyer Sammy Gyamfi, has served notice to the effect that, the party is going to file for an appeal at the Appeals Court, the second highest Court of the Land.
He made this assertion during a live interview on TV3's mid-day news.
This move he says, has been necessitated by what he terms as, "injustice" by the Cape Coast High Court.
The Cape Coast High Court today, has pronounced the Assin-North Parliamentary elections results as null, void and has ordered the electoral commission to conduct a by-election. Mr James Quayeson, the current MP for the constituency has been ordered to desist from holding himself as such and also penalized him at the cost of 40, 000 cedis.
Mr James Quayeson per the ruling of the Court, was still a Canadian citizen at the time he registered to contest for the Parliamentary elections because his application to renounce his citizenship was only approved after he had succesfully registered as a candidate and stood for the elections. The Court indicated that, his letter of renunciation alone did not qualify him to contest because he needed the approval.
As usual, an appeal is expected and if it does not succeed at the Appeals Court, the Supreme Court would ultimately be the final alternative.
