A Court Has No Power To Call Upon Any Party To Testify In The Case - Nana B

The National Youth Organizer for the New Patriotic Party (NPP), Mr. Henry Nana Boakye popularly known as Nana-B has been reacting to the request of the National Democratic Congress lawyers of demanding Electoral Commission chair, Jean Mensah testify on the Election Petition.

According to Nana-B, the court has no duty to call on a party to testify in the case. He made this argument in a recent Facebook post.

"The court has no duty to call on a party to testify in the case; the court acts as an unpure and only hears such evidences as the parties will proffer.

Whether the parties will testify or not is non of the Court's business.

Indeed for a court to insist that a party testifies will amount of to the judge descending into the area of conflict.

After determining the triable issues, the trial court leaves the field clear for the parties themselves to decide who will testify.

We know of no law or rule that allows the court to call upon a party to testify in the action.

If such rules exist, it is not applicable in our dispensation." He said
