The Cape Coast High Court presided by Justice Kwasi Boakye has nullified the Parliamentary election held in the Assin North Constituency in 2020. Meaning there is going to be a fresh election to elect a new Member of Parliament to represent the people. The court has also restrained the Assin North MP, Hon Joe Gyaakye Quayson from holding himself as the MP for the Assin North Constituency.
As many Ghanaians can recall, on the night of 6th January 2021, the New Patriotic Party (NPP) leadership led by Hon Osei Kyei Mensah raised a concern for the Assin North MP to be excluded from the election of the Speaker but the National Democratic Congress (NDC) leadership led by Hon Haruna Iddrisu challenged there is not valid injunction on the MP that prevent him from voting as at that time.
In view of that, Hon Joe Gyaakye Quayson was allowed to vote in that election leading to the election of the Speaker for the 8th Parliament, Rt. Hon. Alban Kingsford Sumana Bagbin. There are some Ghanaians who now consider the election of the Speaker illegal because it is now confirmed that the election of Assin North MP was a fraud and illegal. Therefore the result of the election Alban Bagbin could have been different if Mr Quayson was prevented on 6th January.
There are some Ghanaians who believe that NPP should push for a new election to be conducted for Speakership after the by-election in Assin North Constituency to get a valid speaker for the 8th Parliament. If that happens, then Rt. Hon. Aaron Mike Oquaye will get a chance to contest again.
But there are some Ghanaians who believe that the election of the Speaker cannot be conducted again because, by law, the election of the Assin North MP was not fraudulent as at the time the election of Speaker was going on. The only thing left is the High Court need to charge Mr Quayson for defrauding and criminal offence of 2020 Parliamentary elections in Assin North.
