Double Trouble As Fresh Writ Hits NDC’s Jomoro MP At The Appeals Court – Full Details

The aftermath of the 2020 general elections in Ghana has been very interesting and intriguing. Some MPs are still in court battling their cases out.

In the Western Region, one MP who has been very hot in the court after the elections is the Jomoro Member of Parliament, Dorcas Afo Tofey. There is a case against her at the Sekondi High Court where the court has ruled that she should produce the certificate of her renunciation as Ivorian citizenship.

The MP then run to the Appeals Court at Cape Coast to challenge the ruling. But the petitioner in the original case, Joshua Emuah Kofie has also chased her there with a fresh writ.

In a writ filed at the Appeals Court in response to a stay of execution application by Hon Afo Tofey, Mr. Emuah Kofie stated that it is rather bizarre for the MP to go this length to evade the production of a document she claims does exist. He indicated that if there is no document to evidence the applicant's renunciation of her Ivorian Citizenship as she stoutly maintains, then she humanly cannot produce any such document.

Referencing the stay of execution application, Mr. Emuah, who is challenging the eligibility of Dorcas Tofey to contest as MP in Ghana, stated that, contrary to the deposition in her Affidavit in support, he is resolute that there has been no such misplacement of the burden of proof by the Court as alleged or at all, adding it is altogether curious that, the applicant who has by her showing indicated that she has indeed renounced her Ivorian Citizenship in November 2019, would fall shy of the court’s orders to produce any such certificate of renunciation.

He prayed the court to strike out the MP’s application for a stay of execution after the Sekondi High Court had asked her to produce the said certificate.

“I am further advised by counsel and believe same to be true that, Applicant has woefully failed to establish any exceptional and/or special circumstances, to warrant a stay of execution of the court’s order for production. By reason of the matters aforesaid, I pray the Court to dismiss the application as being not only frivolous and vexatious, but devoid of any merit,” he stated in his writ.

Now there is double trouble for the Jomoro Member of Parliament on the ticket of the New Patriotic Party as her election is currently in limbo. We can only wait for the court to bring finality to the issue.
