The Supreme Court of Ghana has finally given it's analytical verdict on the election Petition case between the president elect ,Nana Addo Danquah Akuffo Addo and the ex-president Mr. John Mahama of NDC in an explicit judgment .
The court preceedings which ended on Thursday the 4th of March 2021 ,was a deliberation through the laws of Ghana on the 2020 elections to clarify the winner of the elections. The court case was spearheaded by a seven-member panel of judges , presided by by the Chief Justice, Kwasi Anin Yeboah .
The political litigation was not anything new to the forth republic of Ghana, because it happened the last time ex-president ,John Mahama was elected into power ,under the same circumstances of election malpractice. Then president Akuffo-Addo who was a candidate of the New Patriotic Party ( NPP ) then ,also summoned the electoral commission to court on charges of results rigging.
The current election petition which took a couple of weeks in 17 different sittings ,was a time of tension between the Lawers of the petitioner ( John Mahama ) and those of the respondents ( Akuffo-Addo and the Electoral Commission of Ghana. ).
According to the plaintiff ( John Mahama ) , the election should be re - conducted ,because the Electoral Commission ( E C ), led by the chairperson Madam Jane Mensah, made mistakes in the counting of the results, by excluding some constituencies during it declaration of the results.
However, the court took a concrete decision on the issue, stating among other things that the plaintiff, has no evidence of proof to back up his claims. So in that case there is no need for a re-run of the elections. Thus the petition was dismissed as not valid ,and has no merit to it .
During a across examination by Mr. Aseidu Nketia, it was quite clear that NPP's President Nana Akuffo-Addo won by popular vote which exceeds 50 % of the total votes cast .Thus ,refuting the Petitioner's claim that there was no winner in the just ended 2020 elections .
Akuffo-Addo won by 51.302 % against John Mahama who had 47.359 % ,which actually means that the difference is 4% , which is seen as the highest gap in between candidates since 1996 .The supremacy of the court's decision presupposes that, there is nothing the loser will do against the verdict ,especially within the judiciary of the republic of Ghana .
