Today, February 18, 2021 marks another day for hearing of the petition filed by Mr. Mahama at the Supreme Court over the outcome of the 2020 presidential election. Mahama who lost the election is contesting the results on grounds that the election was flawed and none of the candidates secured more than the required votes to win.
Prior to the hearing, the Petitioner had filed to more applications for a review of the court decision and also for a stay of proceedings. This issue sparked a longstanding legal tussle between the Counsels for the Respondents and the Petitioner. The panel was reconstituted to make it a 9 member panel to decide on the application.
At today's hearing, the most contentious issue before the Court was to decide on another application that was filed by Mr. Mahama for review of the Court's ruling on the application to reopen their case. Tsatsu Tsikata in his submission attempted to impress the bench but his motion was objected by the Lawyers for both Respondents.
After a series of debate and argument, the Supreme Court announced through the Chief Justice that the application for the review of the decision has been dismissed. The Court insists that the Chairperson of the 1st Respondent cannot be compelled to mount the witness box.
This was one of the several unanimous rulings passed by the Court since the petition hearing commenced. The case has been adjourned and the panel is expected to reconstituted again.
