The hearing of the Election Petition will be starting soon. Lawyers for the Petitioner and Respondents are lacing their shoes for the encounter. John Mahama, who happens to be the Petitioner is seeking Ghana’s apex court to annul results of the 2020 election and order for a rerun of the elections. According to John Mahama and his team the results did not reflect the true reflection of the elections.
In an interview with OB on Ekosii Sen, Kojo Oppong Nkrumah, the spokesperson for the President on the petition maintained that the contents of the petition are empty. According to him the Petitioners who are desperate have even asked for amendment in their petition. He noted that the court will dismiss the application by the petitioners for an amendment.
The host Osei Bonsu tried to correct him that per the law, amendments could be made as long as it did not change the core of the reliefs or arguments of the case. However, Kojo resisted their calls and maintained that it was up to the court to decide that.
“Who determines what is marginal errors? It will be up to the Supreme Court to decide. We know the court will.” Kojo said. According to him no one can determine any of the contents of the case except the Supreme Court.
Later an another lawyer texted into the show and clarified issues that OB was right when he said that as long as the amendments being asked by the Petitioner relates to typos and not changing arguments, then the correction will be allowed.
Kojo however insisted that only the court could determine the contents of the petition and decide if it was typographical.
It can be recalled that in the petition there were errors regarding the use of 1st and 2nd Respondents identification. Many have argued that this was inconsequential to the case.
