The flagbearer of the opposition National Democratic Congress (NDC), former president John Dramani Mahama and his legal team will today file their closing address and legal arguments at the supreme court.
The former president filed the lawsuit against the Electoral Commission of Ghana (first respondent) and the current president of Ghana and flagbearer of the ruling New Patriotic Party, Nana Addo Danquah Akuffo-Addo (second respondent). The suit is intended to challenge the outcome of the 2020 general elections.
According to the former president John Dramani Mahama, the constitutionality of the declaration of the presidential election results on 9th December by the chairperson of the Electoral Commission is questionable. He is therefore among other things demanding that the Supreme Court declares the results of the elections as declared by the EC chairperson null and void. He therefore prays the court to order the EC to conduct a rerun of elections between himself and the second respondent, Nana Akuffo-Addo.
In the course of the hearing of the petition, the petitioner and his legal team have filed several applications, almost all of which were dismissal by the apex court. These included an application to order the EC to furnish the petitioner with certain documents that pertained to the elections. It also included an application to order the EC to mount the witness box. Another application was also filed by the petitioner to seek leave of the court to reopen his case.
All these applications were all dismissed by the Supreme Court for so many reasons as given by the judges. On Monday, 22nd February, the court asked the petitioner to file his final address by the close of today, Tuesday, 23rd February, 2021. The court may however fix a day to give the lawyers an opportunity to make their oral arguments relating to their addresses.
The court is however required to give it's final ruling on Thursday, 26th February, 2021. Let us see how it goes.
