On 29th March was the e-levy accepted. On 2nd or 3rd March, the e-levy was passed as law (The Electronic Transaction Act 2022, Act 1057) in Ghana as the president appended his signature. Sam Okudzeto Abrakwa, Mahama Ayariga, and Haruna Iddrisu sent the Attorney General to the Supreme Court to declare the passing of e-levy as unconstitutional.

The Supreme Court of Ghana has dismissed the application of the three Members of Parliament (MP) seeking to injunct the implementation of the Electronic Transfers Levy (E-levy). The dismissal of the application was a unanimous decision of 7 judges. According to Rockson-Nelson Etse Kwami Dafeamekpor the Member of Parliament representing the South Dayi constituency in the Volta Region, “the Court relied on the doctrine of Omnia pracsnmuntur legitime facta donec probetur in contrarium”.

Minority-Leader-Haruna-Iddrisu Haruna Iddrisu, the Minority Leader in Parliament, and two other NDC MPs have filed an injunction in the Supreme Court to prevent the Electronic Transfer Levy from being implemented (e-levy). Mr Iddrisu, Mahama Ayariga, and Samuel Okudzeto Ablakwa are requesting that the Supreme Court stop the Ghana Revenue Authority (GRA) from implementing the e-levy until their lawsuit contesting its constitutionality is resolved.

The Ghana Revenue Authority (GRA) was also directed by the Supreme Court to save all records of deductions made after the electronic transaction levy was imposed. According to Presiding Judge Nene Amegatcher, who read the judgement, the nature of the relief sought by the minority is null and void.
